Georgia defense attorney subpoenaed to appear before state committee investigating Fulton County District Attorney Fani Willis

Defense attorney Ashleigh Merchant has been subpoenaed to appear before a Georgia state Senate committee hearing on Wednesday as it investigates the actions of Fulton County District Attorney Fani Willis.

Merchant confirmed to CNN that she had been subpoenaed for the hearing, which will be livestreamed.

The Georgia legislative committee, formed in January to investigate the Fulton County District Attorney, said they planned to issue subpoenas as they investigate Willis, the Democratic state prosecutor who brought the racketeering case against Donald Trump and his allies for their actions after the 2020 election.

Merchant, the defense attorney for a Trump co-defendant, is the first person to be issued a subpoena by the committee. She initially launched the allegations of an improper relationship against Willis and Nathan Wade, the lead prosecutor on the case. The controversy has threatened to undermine the case against Trump in Georgia.

At the committee’s first meeting in February, state Sen. Bill Cowsert, the Republican chairman, laid out plans for subpoenas and depositions as part of the investigation into alleged misconduct by Willis.

Cowsert said the panel already has heard from "whistleblowers” but did not elaborate on what information they provided. He said the committee intends to dig into any credible allegations, no matter how long the investigation takes.

Only an appearance of a conflict of interest need be shown to bounce Fani and the Fulton County DA office off the case.  Then the case goes to which county that has the resources to continue? Or a Democrat DA?  If Fani I'd bounced the case has a high percentage of being dropped altogether.

Where is the conflict of interest? All they've done is muddy Fani with a salacious story of an office affair. 

Which is the entire goal: obfuscate & delay. Shift the narrative. 

There's nothing that has been shown that constitutes a conflict of interest.

Fani hires lawyer with no previous RICO or felony prosecution experience.  Same lawyer is highest paid attorney contracted.  Fani happens to be in relationship with said lawyer and took trips with said lawyer and "reimbursed with cash".  Therefore no records.  Then lies about the relationship regarding when it started.  Allegedly. 

 

Lawyers friend and ex law partner and her own friend provide testimony that the relationship began prior to Wade being contracted.  Then today the defense submitted another motion with further testimony from another county's senior assistant DA who besides stating that Wade's law partner recounted the same story to her, but witnessed a call from Fani instructing the law partner to not tell them anything because they were "coming after them" over Wade's billing.

Georgia law only requires the appearance of conflict by a prosecutor.   And in the terrible closing argument made by one of her ADA's , the judge reiterated that fact and did not accept the multiple arguments made to the contrary.

That is simply false about the law in Georgia.

The conflict of influence has to be both proven (not just "the appearance") and needs to be shown to prejudice the defendant. 

Fani acted stupidly here. But nothing in an improper relationship here prejudices Trump.

Prejudice is not required per Sales 316 GA appellate 727.  This case found that a personal benefit disqualified the prosecutor and the denied motion to disqualify merited a retrial.  

 

"Personal benefit" is unfortunately not defined by Georgia law.

Reminder that the context of John's original comment was that none of this exonerates Trump. And it doesn't. Your boy comitted crimes and is going to be held accountable for them (finally), so clinging to these shreds of hope just come off as desperate and naive.

And I addressed his statement that conflict of interest has to be proven, which it does not.  If Wade gets disqualified for being stupid about the situation, the entire Fulton County DA's office could get kicked as well.  

 

It is an unnecessary mess which could result in the case being dropped by another county's DA for any number, but more than likely political reasons.
