Per FAA regs ADS-B is not supposed to have an OFF switch and the signal is unencrypted to maximize participation. The military has a waiver to operate with it turned off, which basically solves both issues; although there was blowback on that after the D.C. helo accident.

TCAS uses the aircraft transponder. The big advantage of ADS-B for ATC is that it updates the aircraft's position every second, versus a normal ATC radar which varies between 5 and 12 seconds.
