NORFOLK, Va. — The U.S. Drug Enforcement Administration is considering a recommendation by the U.S. Department of Health and Human Services to reclassify marijuana from a schedule I to a schedule III drug.

This would not make marijuana legal at the federal or state level but could have a big impact in the Commonwealth.

"This is an industry that’s tens of billions of dollars on the state-legal cannabis side," said Columbia Care Senior VP of Corporate Affairs Adam Goer.

Columbia Care operates 10 medical marijuana dispensaries in Virginia, including one in Suffolk that opened in August.

Goer said the reclassification could have a big impact in Virginia.

"We service tens and tens of thousands of Virginians, many of whom are suffering from debilitating life conditions," Goer explained.

Currently, a schedule 1 drug is one that has no currently accepted medical use and a high potential for abuse.

Drugs like Heroin, LSD, and ecstasy are in that group with marijuana. Drugs like cocaine and fentanyl fall into schedule II.

The reclassification would change the way marijuana businesses are taxed, which supporters say could help businesses lower prices, perhaps making the products affordable for more people.

Supporters also say the reclassification would open up new research and banking opportunities.

"It will now possibly open up the ability for these individuals in these businesses to now do businesses with banks," said News 3 Political Expert Dr. Eric Claville.

According to The Motley Fool, a fully operational recreational marijuana market in Virginia is estimated to generate almost $140 million a year in excise tax revenue, suggesting the businesses could have a lot of money to be taxed.

That means they could have a lot of money they could use, for example, to get loans from banks.

"The financial impact would be monumental as it relates to interest that would be charged to banks," Dr. Claville said.

As of September 2023, marijuana could only be sold in Virginia for medicinal use but anyone 21 and older could possess and use up to an ounce and could grow up to four marijuana plants.

The DEA does have the final say in reclassifying or not reclassifying a drug but has never overruled a recommendation by the Department of Health and Human Services.

I'll be curious to see if this happens and if it does, if places like the VA can begin prescribing it.

What's going on there in VA?  I thought it was full recreational sales from Jan 1, 2024.

The legislature put a hold on approving recreational dispensaries, which I think is indefinite. Medical dispensaries are popping up all over the state, though. 

If the Federal Government changes the classification from Schedule I to III, then it's possible that the VA may be able to begin prescribing it for medical purposes. But that remains to be seen.

Well if you want legalization you better vote for Dan McCaffery for Supreme Court. Because Ultimately they will decide that the leglislation is constitutional or not. 

Not to confident the Republican led senate will approve any bill. 

the hypocrisy of this state pushing back against cannabis, when it already controls alcohol distribution and sales, is mind blowing.

It's straight-up idiotic with nearly all the states along PA's borders having legal pot. I guess they don't want the jobs and tax revenue? Like I said before: We'll be the second to last state to legalize, just before Alabama.

Voters in the Buckeye State said "yes" on Issue 2 — a citizens’ initiated measure legalizing the possession, home cultivation, and retail sale of marijuana for those age 21 or older.

Despite public opposition from the state’s GOP-led Senate, Republican Gov. Mike DeWine, the Chamber of Commerce, county prosecutors, and others, voters decided in favor of facts, not fear.

Ohio is the 24th state to legalize the adult-use cannabis market, and it is the 14th to do so by a public vote.

Dave’s not here. 

Too bad voters in PA can't get a referendum and put weed on the ballot and ask the voters for yes or no vote like they did on Ohio. That power is left up to the State Legislature. Which they won't do until Dems take control of both houses.

the saddest part about it is, most of the people want it legalized, but the state reps refuse to reflect the wishes of their constituents and instead, keep on being hypocrites as they refuse to make cannabis recreational while at the same time being ok with the state controlling alcohol sales. 

 

now the state is going to lose even more tax revenue as people cross state lines to get their product.
