There's a bunch of cases against Trump that were pure political "Lawfare" as you would have it and the NY one they nabbed him for was one of them. Trump was guilty of that, as James is probably guilty here, but neither of these cases exactly shine as deserved justice.

That said, Trump 1000% is guilty of treason both for Jan. 6 and his election meddling especially in Georgia. So there's also that.

You can't do a long term rental in the first year. The 2nd home rider states that the buyer will keep the property available "primarily as a residence for Borrower's personal use and enjoyment for at least one year". So if she only rented it out for a few months during the first year, then she didn't violate that clause. Now, if shortly after buying the home she entered into a 12 month lease with a tenant, then that's a different story. But as of this point, we don't know what we did as we haven't seen the evidence against her.

POLITICO obtained James’ mortgage documents, including her signed "Second Home Rider” from the Norfolk Circuit Court Clerk’s Office. The rider, a standard addendum to mortgage contracts developed by Fannie Mae and Freddie Mac, requires James to "maintain exclusive control over the occupancy of the Property, including short-term rentals." The idea is to restrict buyers’ ability to use a "second home” as an "investment property” — by hiring a management company and using it primarily to generate income — after obtaining the lower loan rates associated with houses purchased as vacation or "second” homes.

That final, three-word phrase in the rider — "including short-term rentals” — could be decisive. In plain English, the provision means that James is explicitly permitted to rent the place out periodically, so long as she remains in charge of matters such as the number of tenants and how they use the property, legal experts say. The contract’s restrictions bar James from giving "a management firm or any other person or entity any control over the occupancy or use of the Property."

You don't read so good counselor.

The three words are "including short-term rentals", which are allowed.

The pittance of income she received in 2020 on which this case is based - $1,350 to cover utilities - is consistent with a short term rental.

The state has to try and prove that she mislead lenders by intending to use this property for long-term renters.

They will lose this case, spending millions of taxpayer dollars in the process.
