Every LE official has to pass the probable cause test when you challenge a person's 4th amendment rights. ICE can legally approach someone and engage in a consensual conversation. The second that consensual conversation goes to a detainment/arrest, you HAVE to have probable cause that the person committed a crime. While the standard for probable cause is "proof of a fair probability", the standard for reasonable suspicion is "an articulable belief that criminal activity is afoot" and it usually requires a combo of factors, not just one.

If this were REALLY about deporting illegal immigrants, the solution really isn't that complicated. Trump should have cut off federal funding to all sanctuary cities unless they agreed to the following: (i) turn over all illegal immigrants in custody to ICE for deportation and (ii) check the immigration/citizenship status of every person arrested or even cited (speeding for instance) and detain and turn over all illegals. He could have cut off funding to states that issue drivers licenses to illegals and demand those names be turned over. All of this could have been done by restricting federal funding and forcing local law enforcement to cooperate.

Instead we basically have Ernst Rohm and the SA running around.

Person shot in incident involving Border Patrol in Arizona

The Santa Rita Fire District reported the shooting took place in Pima County near milepost 15 of West Arivaca Road.

A person suffered critical injuries after being shot during an incident involving the United States Border Patrol in Arizona the morning of Jan. 27.

The Pima County Sheriff’s Department said it responded to a shooting involving Border Patrol in Arivaca, an unincorporated community the southern part of the state about 10 miles north of the border with Mexico.

The shooting took place about 7:30 a.m. local time near milepost 15 of West Arivaca Road, the Santa Rita Fire District said. The scene is just over 50 miles southwest of the city of Tucson.

The person was taken to a hospital with life-threatening injuries, local officials confirmed.

"We are working in coordination with the FBI Phoenix-Tucson Office and U.S. Customs and Border Protection” the sheriff's department posted on social media.

A. There's no content generation there, so it wouldn't happen.

B. That's a pretty big can of worms you'd be opening up there. What's to stop a Dem Prez from withholding federal funding from West Virginia until they clean up their meth problem or until they start paying more in taxes than they take?

On B - nothing. Now, I'd argue that he'd need Congressional approval to withhold mandated funds specifically allocated to a state, but the all administrations gets a ton of leeway from Congress on disbursing funds. Generally Congress simply sets aside a certain dollar amount and leaves the actual administration of grants, loans, etc. to the relevant department. So it is legal, and it's been done before. It's actually codified by Congress in the Highway Bill that no funds may go to a state with a drinking age below 21 - this is how we have a national drinking age despite the Tenth Amendment.

There are plenty of programs that either OMB or other departments have wide discretion over. Obama did it for the ACA, and withheld education funding for LGBT issues. It's not a new playbook.

I remember that well. Happened when I was in college in Virginia where it had been 18. I was grandfathered in so no issue but it was more fun generally when everyone at school was legal. My brother missed it by a year right when he was starting college and was always pissed off about it.

btw - Everyone used to drive over the line in Hockessin or up on 52 or 202 as it was 20 in DE and there were private liquor stores as opposed to PA at 21 with State Stores. Every major road had liquor stores in DE right over the border from PA due to both sales taxes and drinking age.

Yeah this is about the optics and terrorizing blue states. There are far more illegals in Texas and Florida, but they have no interest in pulling this crap there.
