July 3, 20241 yr Outside of the doomer-ism that usually plagues left wing talking points, ultimately the ruling wasn’t that bad. If the President doesn’t have immunity for official acts, then you get the BS that was going on for the Johnson impeachment. Where they failed, IMO, was not creating a test for what determines an official act. I mean, even if they did, anything applied by the lower courts would get appealed to them anyway, but it would have curtailed the ambiguity. Most any ruling they could have made would have kicked the can down the road, but what is lacking is knowing what the ruling will be when the can is picked up.

Without this, we're in wild west territory of lower courts fumbling through and trying to figure this out on their own which is why you get a postponement of a sentencing hearing for crimes committed before he was even elected. They literally left out the most critical part of the ruling which is precisely what makes it "that bad."

It is a messy area but in my mind SCOTUS failed the test particularly in the area of not allowing "official acts" (whatever those are) to be included as evidence in cases trying "acts that are not official".
