Jonathan Turley, a Fox News contributor and constitutional-law professor at George Washington University, compared Biden's pledge to college admissions and tried to argue that picking a Black woman would be unconstitutional under any other circumstances.

"And the irony is the Supreme Court just accepted two cases on the use of race preferences in college admissions," Turley, who was a pro-Trump impeachment witness, said over the phone. "And so this is obviously going to come up where the president's going to have to decide if he intends to fulfill a pledge that the court would never allow if he was actually admitting someone into a college."

Faulkner replied, "Jonathan Turley, what you're talking about is discrimination."

My expectation is that Biden would want the most qualified person, regardless of sex, color or ethnicity.

He made a clear declaration that he wasn’t remotely interested in doing that, and he definitely deserves to get flamed for it. 

The smart politics would be for the Republicans to ask tough questions, but let the nomination sail through.

Even if Biden had every intention of putting a black woman on the court, why make that public? The fact he so brazenly flaunts criteria based on race and sex is disturbing to say the least, and further normalizes this behavior.

So 40 years ago when Reagan put the 1st woman on the Court, do you think he picked the most qualified person?  Because I think you could make the argument that he didn’t.

It was a campaign promise made by Reagan to put the first woman on the Supreme Court.
