FWIW, the law that led to the rule change under Obama was passed back in 2007. The rule didn't take effect until December 2016. 2 months later Trump signed a law (passed by Congress) nullifying it. Presidents aren't kings; they maybe could have passed some legislation that restored this, but it would have needed to survive a Republican filibuster. In 2007 I guess that was something Congress could reasonably agree to, but Congress in these times ... well, I have little hope that 10 Republicans would have been willing to buy into a cloture vote on this. That said, I'm frankly shocked at how much meaningful legislation was passed in the first two years of Biden's presidency. So who knows.
