That wouldn't fly in court. Being "spooked" is not a legal reason to deny someone their right to life when the person is prone on the ground. There has to be a reasonable fear.

I agree but I can hear the argument that could be made. It is certainly a FAR better argument then trying to claim resistance in this case.

Passive resistance isn't, legally, reason enough to use lethal force. I'm just saying that if Alex lived, ICE could probably have charged him with that because it's so ambiguous.

Well I disagree with you. It isn't ambiguous. He's got four guys, restraining him, and bringing him down and shooting him within two or three seconds. He has no chance to resist to anything. Four agents restraining him and one telling him to get down (if that was the case) doesn't offer him a chance to resist in a two second time frame. That's just a load of bullsheet.

The charge itself is BS but that doesn't stop law enforcement from abusing it every minute of every day.

For those confused about Pretti firing the gun…

First, compare clothing. Pretti is wearing a dark brown jacket. The agent in a tan jacket. Also, despite being in winter clothing, the agent appears to be quite a bit stockier than Pretti.

Pretti never fired or reached for his gun.

You're just not playing close enough attention to the part of the video with Pretti swaps clothes with the agent like a Penn & Teller magic trick.

The counter point to that being that they shouldn't have been assaulting the dude in the first place for filming with his phone. The gun is irrelevant until they made it relevant.

The ICE agents created the confrontation in the first place. What type of person pushes a women like that? It's not like a crowd was forming and he was trying to create space. What's lost in all of this is how needlessly aggressive these people are. What are they even trying to accomplish?

Any god prosecutor would paint a picture of these agents being ultra MAGA and looking for any excuse at all to murder "libtards". It's not a hard picture to paint because that is exactly what is happening.

Say the gun they removed from him did go off, it's still murder. Shouldn't have attacked him in the first place. No reason to remove the gun. And it wasn't in a position for him to fire it. It's a moot point, regardless of whether or not it is a very very very dumb moot point (it is).

He then grabs his head and shoots him through the back of the head point blank execution style, and his buddies get their shots off. Its all on camera.
