Based on what I can see in the videos that I've watched and considering the totality of the circumstances as I perceive them, this shooting is clearly unjustified. I don't see any articulable facts and circumstances that would lead a reasonable officer, to reasonably be in fear of death or serious bodily injury for himself or anyone else.

I suspect the shooter will argue that 1. He knew the Suspect was armed when the arrest began. 2. He didn't see or know the Suspect had been disarmed. 3. When the Suspect was kneeling, the shooter believed the suspect was freely reaching for his own weapon and he fired in defense before the Suspect could start shooting.

I also suspect that argument will ultimately fail scrutiny at the State level. I expect that Pam Bondi won't recommend federal charges, but that doesn't preclude the DA's office or the State A.G. from empaneling a State Grand Jury and/or filing State charges against the Officer. The Civil case will be a slam dunk although I'd prefer it was never necessary. Mr. Pretti shouldn't be dead.
