The legal system isn't going to conspire to keep it from them. The prosecution may screw up but then the case will be thrown out.

Tens of thousands were arrested for various reasons, some minor offenses more relating to crowd control and others more serious. 100s faced felony charges. Less than 4% of Floyd/BLM protests resulted in property damage. Meanwhile 100% of Jan 6 protests resulted in the storming of the Capitol building while Congress was in session.

Exactly. if either side withholds evidence, it may not be submitted as evidence, and the case may be dismissed. Judges strictly enforce the Rules of Evidence especially in criminal trials.
