It was a pain. Although it was kind of funny how they weren't able to get into the trunk and instead opened up the gas tank. When crap like that happens you need to find some humor

Maryland has the castle doctrine but I didn't have a gun at the time. I think the castle doctrine only applies for where you are physically though so an empty car being broken into shouldn't apply

You mean like customizing it or restoring a classic?

Either way it's not the same as a house IMO 🤷‍♂️

An empty car doesn’t apply. The car needs to be occupied for the castle doctrine to come into play. I believe he’s trying to use the stand your ground defense and  say he felt his life was in danger after the guy broke into the car.

This was the guy that was shot in the back? I don't see how that would work because it'd mean he was looking away from the house. I could maybe see it if the guy was going towards the house

If somebody is trying to break into your car while your in your house I don't see any way that is a threat to your life, which is the main justification for the use of deadly force.  This shooting may be allowed under Florida law, but I think the homeowner is in the wrong morally based on what we know at this point.

Well stated.

Maybe he was backing in

A good butt-whupping is all breaking into your car rates.

Unless it is in your garage. I think back-shooting a thief who is not threatening you with bodily harm, in the street is murder.

'Course, I'm not from Florida.

Or a 70-something year old blue hair who’s butt whipping days are 40 years behind them. Keep in mind, those are the people voting on the laws down here.

If I'm a criminal I'm moving out of Florida and moving next door to toaster

So, serious question for everyone living outside of Florida....

Here, we have castle doctrine/stand your ground and CCP. If someone breaks and enters into your home (or occupied vehicle) you have no obligation to flee, and use of deadly force is authorized. Outside of the home, you must have a CCP to carry, and that alone gives the obligation to prevent felonies, as well as using deadly force to protect yourself from harmful injury or death.

so, the question is, how in the world does that differ from your State? Im asking, because to me it seems perfectly reasonable to protect your home AND yourself when outside of the home (ONLY if you have a CCP).

Pretty much the same in Indiana and yes i have a ccp

You have the right to protect yourself and others in Pa and it's technically an open carry state.

This stand your ground case has been going on for a couple years while this guy sat in jail. He was freed a couple of weeks ago.
Scenario: guy pimps our his niece on Backpage, and uses his house. Deputies arrive one night to make an arrest. As they try to pull her out of the house she screams and he comes out, guns ablazing, shooting one deputy in the chest, almost killing him (he spent quite a bit of time in the hospital).

Judge says "because the sheriffs department didn’t properly identify themselves ”, the guy goes free.

This is a local news story, and everyone in my area has been following it.

At that point you separate the two charges. He still needs to serve time for the crime of pimping out his niece. But there's an argument to be made that the deputy got himself shot by not properly identifying.

She did some time for the prostitution (180 days I believe). His charges were attempted murder. The sheriffs had vests and jackets on with SHERIFF emblazoned in yellow, but, it was nighttime and he said he couldn’t see the letters.

And nothing of value was lost.

Except my tax dollars to send out three deputies to make an swat style arrest for a girl giving hammer head willingly.

I take it the police cars didn't have their lights on?

How dumb do you have to be as a cop to not identify yourself? Especially in the hood.

The shooting happened Aug. 20, 2015 and according to an arrest affidavit, DeRossett has never wavered in his argument that the shooting was done in self-defense.

He said he was inside while agents were attempting to arrest his niece, Mary DeRossett, on prostitution charges.

John DeRossett said his niece began calling for help. He said he saw three men in dark clothing surrounding her and fired a shot in the air. He said that drew return fire from the agents.

"Mr. DeRossett fired his gun back toward the individuals who were shooting at him on the left and the center," the affidavit stated. "Mr. DeRossett stated that he never heard the individuals in his front yard say anything. He also could not say what they were wearing other than dark clothing."

The affidavit stated John DeRossett told investigators he had a right to defend himself. It also quoted an agent who was with Smith as saying DeRossett started firing while they were struggling with his niece.

Yeah it's not hard to tell if someone is a cop. Even in the dark.

Lol if you think she was willing.

typical trumpcuck response - well he j-walked in middle school so he had it coming to him. also, he should've just put his hands on the dash and been a super duper, extra polite as to not upset the officer, causing him to lash out at an imagined mockery of his authority.
