Right. If Pretti's firearm was discharged then it happened after it was removed from his possession which you can tell from the videos as you can see the agent holding the weapon before you hear any shots. If that is what happened then it would of course cause further confusion and anxiety.

One thing I keep hearing from the MAGA influencers is that Pretti resisted arrest. Is anyone seeing that? I see him just getting tackled and not any resisting going on.

Yeah... i very rarely will ever put someone on ignore, even a MAGA moron, but if lynchedbot3000 has malfunctioned to the point that all he can do is ultraspam lies over and over then I'm taking the plunge.

For those confused about Pretti firing the gun…

First, compare clothing. Pretti is wearing a dark brown jacket. The agent in a tan jacket. Also, despite being in winter clothing, the agent appears to be quite a bit stockier than Pretti.

Pretti never fired or reached for his gun.

If anything, he was just dead weighting and pulling away.

Different states have different standards and sometimes even different levels. For example in Florida there’s a resisting w/o violence charge.

At that level on the Chicago use of force continuum (the most common one used by police departments), that would be classified as passive resistance, so the appropriate actions would be soft hand techniques (pressure points and joint locks), not, you know, getting spooked by a desk pop and shooting an unarmed man five or six times.

You mean getting tackled and knocked down is some form of passive resistance? Makes no sense. He never had a chance to resist in any form. He went to help the lady and then they jumped him, took him down, and then shot him. All in about three seconds. The natural reaction when being taken down is to try to break the fall a bit so you don't hit your face on the street. That action certainly can't be judged to be resisting. What else did he do? If this was a 30 second topic and he was holding off going down to his back/stomach then I can understand that thinking. That is not what happened here.

This whole episode is so clear cut that it’s mind boggling to even suggest otherwise. Even the part of resisting is a stretch IMO. The guy was trying to help the woman off the ground when he was pulled back and jumped by the ICE people. He’s on the ground and they are all over him. One guy is striking him on the side of the head with an object, while the others are holding him down. The handgun is taken from his holster and seconds later on shot is fired which precludes a barrage of shots from ICE.

Sure, you could say that he shouldn’t have put himself into that situation, even if he was trying to help the person who was getting jumped in the first place. That still doesn’t change the fact that he was executed by these clowns.

Examples of passive resistance are not getting out of a car when told to and instead asking for a reason, putting your hands up in a non combative stance while being told to get on the ground, and basically any form of not following instructions perfectly.

It's law enforcement's way of charging someone with resisting when they aren't actually actively resisting.

Right but none of those types of things are in play in this situation. There simply is NO resistance passive or otherwise.

You need to get beyond what you see in the video and what any reasonable person would be doing. If one of those ICE agents is yelling for him to put his hand behind his back and he's down on all fours then LE will have no issues with charging him with passive resistance. The charge is basically used by every cop who desperately wants a reason to detain or arrest when they can't find a crime that's actually happened.
