Trump likely committed felony with plan to obstruct Congress, U.S. judge rules

WASHINGTON (Reuters) -A U.S. judge ruled on Monday that former President Donald Trump "more likely than not" committed a felony by trying to pressure his vice president to obstruct Congress and overturn his election defeat on Jan. 6, 2021.

The assertion was in a ruling that found the House of Representatives committee probing the deadly attack on the U.S. Capitol has a right to see emails written to Trump by one of his then-lawyers, John Eastman. The judge said that Trump's plan to overturn his defeat amounted to a "coup."

"The Court finds it more likely than not that President Trump corruptly attempted to obstruct the Joint Session of Congress on January 6, 2021," U.S. District Judge David Carter in Los Angeles said in a written decision.

 

Representatives of Trump and Los Angeles-based Eastman did not immediately respond to requests for comment.

Carter has no power to bring criminal charges against Trump. That decision would need to be made by U.S. Attorney General Merrick Garland, for violations of federal law.

The Capitol riot occurred as then-Vice President Mike Pence and members of both chambers of Congress were meeting to certify Democrat Joe Biden's November 2020 election win.

"Dr. Eastman and President Trump launched a campaign to overturn a democratic election, an action unprecedented in American history," Carter wrote. "Their campaign was not confined to the ivory tower - it was a coup in search of a legal theory."

The Democratic-led committee was formed to investigate last year's Capitol attack by thousands of Trump supporters, more than 750 of whom have been charged criminally.

The committee said earlier this month it believed Trump may have committed multiple felonies.

Before the mob stormed the Capitol, Trump gave a fiery speech in which he falsely claimed his election defeat was the result of widespread fraud, an assertion rejected by multiple courts, state election officials and members of his own administration.

"More than likely," etc., are all subtle way of saying "We know he did this, but we can't prove beyond a reasonable doubt in a court of law that he knowingly broke the law."

It's like I've been saying all along, the mens rea requirement is more than likely going to save Trump. It's the reason that the NY case seems like it will never even get off the ground, and it will likely be the reason he is not charged with a federal crime, either. There is a glimmer of hope that something might come out of the GA case, since we have the Trump phone call with Raffensperger, but even that is not a slam dunk.

I want his fatass stuck in solitary confinement more than anybody in here, but I'm really not getting my hopes up.

While the sane (or at least somewhat sane) world is dealing with trying to combat Putin, Donny is asking him for dirt on a guy he lost to 16 months ago.

Certainty traitorous, and while it's not categorically fascist, it is characteristically fascist. The act itself of attempting to manufacture dirt on your political opponent in order to falsely connect him to criminality (in a likely attempt to have them prosecuted and unable to run against you) is right out of the fascist playbook, not to mention he's asking for a literal fascist in Putin to help him out.

By this point, what I'm really saying is, "par for the course."

At the very least, I highly doubt Trump himself will be indicted. Like all good mob bosses, he'll have a fall guy.

His hold on his cult really is one of the most inexplicable things I have ever seen. Especially since everything they attack his opponents about is much worse for Trump. It's like living in an absurdist comedy. Nepotism, dementia, handling of classified info, etc. - it's just AMAZING.

I guess, despite having basically zero regard for the intellect of the average voter, I somehow overestimated them...

Honestly it’s really a combination of things that came together at the right time.

1. Baby Boomers. Pretty much bar none the worst generation to ever exist in American history. Not to say that other generations don’t have their faults, however. Boomers grew up in an era of unprecedented American economic expansion thanks to their parents demolishing any worldwide economic competition. Add in that their parents who had just been through hell wanted them to succeed and not have the lives they did, so they were provided for. Things were cheap and plentiful. But then you have the drive of the counter culture. Baby Boomers don’t like to hear the word "no”.  That’s been their mantra since the 60s. And even with conservative boomers. They don’t like to be told no, either. They’ve never had to do without, and they don’t even want to entertain that concept. For a boomer, hearing "no” goes against both the amount that has already been provided to them as well as the counter-culture philosophies. Not to mention that Boomers for the most part think that they matter as individuals, that they’re the most super important people. So in this new era where you have a growth of culture that they don’t understand, in a world of economics that they don’t understand, in a world where things won’t be as good as they used to be, they look for something that is protective of their culture and their  provisions.

2. The education system. Americans are taught how to remember facts, but not how to interpret them. Even in college where you’re supposed to get a rounded education, how much education do you think the average student is really getting? You think Communication majors are really taught how to think for themselves? Of course not. Colleges aren’t for learning. They haven’t been for awhile. Colleges are for the experience. 

3. Social Media. What social media allowed was for every village idiot to not only have a voice, but to find other village idiots with which to talk to. Previously you got your news from a paper and on the 6 o’clock news. It was carefully crafted, and put out by professionals. Now you have every Tom, D, and Harry putting out opinion pieces and "analysis” and people taking them as fact because no one knows how to obtain their own opinion from the facts as they exist. And also with social media you’re getting the headlines of idiocy, and there’s nothing substantive that people will read. You get a paragraph at most of complete idiocy versus a well thought out but long article in say the NYT or WSJ. That and they share crappy memes about how they’re so much better than the newer generations because they had to walk to school. News Flash Karen, the generation before you had to walk across France while getting shelled by German 88’s, nobody gives an ish that no one told your generation not to stick a fork in the light socket so you all had to find out the hard way. 
 

So basically you have a mass of self-important people unable to come to terms with change, who have found an ability to link up with each other to spread idiocy instantaneously. Enter Trump. 
 

Trump was what normal people thought of as rich. They imagined how things would be for them if they were rich. Gaudy living conditions, your name on everything, European wives. Trump is what your average person north of 50 thinks of as rich.  And those morons who were massing on the internet saw Trump as a way to return to the form of yesteryear when they didn’t have to adapt to change. "Why should I change to around America, when America can change to fit around me.”

”…ask what you can do for your country” was a political message for the Greatest Generation. Make the country as a whole better. 
 

"Make America Great Again” was a political message for Boomers, but they don’t see it as making "America” great. No, for Boomers it’s code to make them great again. 
 

EDIT: this isn’t to say that I completely detest and abhor baby boomers. It’s not at all what I’m saying. Especially since I’m a millennial, a generation that as a whole sucks. It’s just that there’s a large chunk of every generation post the greatest generation that really sucks.
