It's based on the justices' interpretation of law and the constituion. There's a reason why Roe was overturned last year, and I'd say it had more to do with personal bias / beliefs influencing their interpretation of law and the consitution. Hell, Gorsuch flat out said Roe was settled precedent and made a big deal about "precedent being the anchor of law" in his confirmation hearing only to flip when it came time to actually issue a ruling.

I forgot to mention that the Wisconsin Supreme Court now has more dems than republicans. First time in decades. I also believe that's the case in PA as well.

edit: fact checking myself here, it was the appeals court not the state supreme court that ruled in his favor. My bad.

The Colorado decision that sparked all this was for the primary ballot.

This opinion opens the door for a further challenge on the 14th Amendement. They didn't fully decide the issue.

The Minnesota Supreme Court declined to become the first in history to use Section 3 of the 14th Amendment to prevent someone from running for the presidency. The court dodged the central question of the lawsuit — does Trump’s role in the Jan. 6, 2021, attack on the U.S. Capitol disqualify him from the presidency — by ruling that state law allows parties to put whomever they want on the primary ballot.

"There is no state statute that prohibits a major political party from placing on the presidential nomination primary ballot, or sending delegates to the national convention supporting, a candidate who is ineligible to hold office,” Chief Justice Natalie Hudson ruled.
