January 3, 20241 yr An attorney representing former President Donald Trump appeared to make a Freudian slip during a recent interview defending the ex-president's ballot eligibility. During an appearance on extreme right-wing streaming network Real America's Voice, Christina Bobb — a former Trump administration official and anchor for the far-right One America News Network — appeared to suggest that her boss should be allowed on the 2024 Republican primary ballot even if he incited an insurrection. "The president is elected by the entire nation and it should be the entire nation who determines who they want for president, whether they are guilty of insurrection or not," Bobb said.
January 3, 20241 yr A little bit surprised Trump is appealing this CO 14th Amendment case and it worries me he's doing so with some intel that SCOTUS might side with him on it. The guy at the end says SCOTUS needs to give a nationwide ruling on it. Perhaps Trump feels he has no choice with the number of states currently litigating his ballot eligibility (17 I believe). The worst thing SCOTUS could do (other than side with Trump summarily) is rule that Congress is empowered to decide; that would be damaging in the long term to punt a constitutional decision to a partisan political entity.

If Scotus follows the Rule of Law and the Constitution then their path is clear. Trump is unqualified. But who knows what this court will do. Congress doesn't need to act to ban Arnold Schwartzenegger from running for President or for someone under 35 nor do they need to act for someone engaged in insurrection. Trump's filing with the Court is a legal joke. It should be laughed out of court.

Arguing that the 14th Amendment is meaningless is not a winning strategy even if you admit he incited insurrection.

Trump's filing with the Court is a legal joke. It should be laughed out of court. Plus, it's the perfect time to disqualify Trump in the interest of fairness to both parties. Not one primary vote has been cast yet; Republicans would still be free to cast their vote for whichever eligible candidate they choose. So many problems would simply go away if Trump were to be declared ineligible. The nightmare of having a candidate for President facing 91 felony counts in 4 different court cases, Trump's "base" disappears back into the holes they crawled out of, and I believe Biden would drop out if Trump is off the ballot. Pragmatically, it's best if SCOTUS rules to disqualify Trump Legally, I think upholding the CO decision and ruling states have authority under US election law is the proper ruling Realistically, I think SCOTUS will strike it down and come out with some BS written opinion that "the voters must decide" -- in order to spare one person who has caused the entire issue because he refused to recognize democracy and the voters' will. It would be an historically sad day.
