February 6, 20241 yr Now comes more dealy. Trump will file for En Banc review. Hoping they will deny that outright. Then an appeal to SCOTUS. Hopefully, SCOTUS will not grant Cert. I expect this trial now to happen sometime in July.

But on something of this importance, I'd think SCOTUS would want to issue the final word.

If he votes that a president has total immunity forever he should be impeached.

He won't want to be on the wrong side of 8-1.

He was already the lone dissenter on the Jan 6th records subpeona ruling. Despite the fact that he knew his own wife had been texting Meadows for weeks leading up to that day.

Chutkin wrote a very strong opinion and it has been affirmed by another 57-page unanimous opinion from the DC circuit court. It's in the public interest to get the trial underway, and when Trump files his appeal to SCOTUS on February 12 they will decline to hear it.

I do think this ruling should be even more straightforward than the Jan 6 ruling, so I wouldn't be surprised if he joined in voting 9-0. But I also have no feel for where the bottom is for Thomas. If he's as compromised as some speculate I could absolutely see him dissenting. I'm a very casual court/law observer, but I have to think there would be a way for the SC to issue guidance on this without even seeing a case in some manner simply affirming the obvious that a president does not enjoy immunity in perpetuity for crimes committed as president. Trump would still appeal to drag it out, but FFS something resembling sanity has to start coming out of this 8 year fiasco before I have to start pricing out houses abroad.

They could deny the stay, deny cert, and simply affirm and adopt the lower court decision. If they put out a statement adopting and affirming the decision 9-0, that would end it.
