March 18, 20241 yr So Trump is asking the appellate court to grant a stay despite his inability to post a bond. While you never say never, it's highly unlikely they will grant the stay. Just so everyone understands, Trump could either get a bond from a bonding/insurance company, or he could deposit the cash into the court register. The issue he will face is appellate bonds aren't like bonds for criminal releases of people on bail. Those bonds only require cash of ~10% because the bond is released and discharged once you appear for trial -- the only risk to the issuer of the bond is that you skip town. In an appellate bond, the chances are very high the bond will be drawn -- less than 20% of cases are overturned on appeal. Furthermore, bonding companies have been less and less amenable to taking illiquid collateral (i.e., Mar A Lago) in recent years. My guess is they want to see a large chunk in cash that Trump doesn't have. Trump's best plan would be to try and quickly raise debt against any unencumbered properties he has, but it's unclear what those could be. If he can't post the bond, he can still appeal the judgment, but he can't stay enforcement of the judgment. The NY AG can go back to court and get the judgment entered and then begin seizing and liquidating assets such as Trump Tower, Mar A Lago, etc. Trump could stop this by declaring personal bankruptcy.

I can't see SCOTUS agreeing to with his immunity arguments. I think they agreed to hear it given the historical nature, but Thomas is the only one who might side with Trump, IMO.
