July 15, 20241 yr The case will be brought again by the Justice Department. Trump didn't get acquitted. If SCOTUS truly wants to go against decades of legal precedent regarding the appointment of a special counsel, then AG Garland simply needs to bring the case himself. Cannon will be eliminated from the pool of judges to be assigned to the case.

July 15, 20241 yr Generally speaking, a motion to dismiss can be appealed when it is granted. I'd assume that happens here.

She was already seeing to it the case wasn't going to begin until well after the election so, if Trump wins, it's a moot point whether she's sitting on it or not. Getting a conviction would have been a Herculean task with her presiding in court, giving jury instructions, etc. She's overplayed her hand here. In some ways it's the best thing that could have happened. Appeal to the 11th circuit, who will likely overrule and remove Cannon from the case. If the 11th circuit somehow shockingly finds the Special Counsel doesn't have jurisdiction, simply bring the case again directly from the DOJ with their own lawyers (which would likely include Smith on the team, anyway).
