Then he mixes in some of the founders' views on concerns about a judiciary that is too strong, but ignores the same founders' views on an Executive that is too powerful. He ignores the plain language of Article III which grants SCOTUS AND the lower courts the authority to hear all cases involving the United States. And you never answered my question. If SCOTUS upholds a lower court decision then that decision is not unlawful. But, then you will just excoriate Roberts/Cannon as overreaching. Just like Levin.

The Alien Enemies Act is to be used in actual war time situations which we clearly do not have at the moment. It can't be any clearer. Trump will lose this one in SCOTUS for sure.
