Yeah.If they rounded this guy up and said "Hey we are deporting this guy because he is a violent gang member" you'd have something. They didn't. They said they made a mistake. Then after this guy likely got killed in prison, they are trying to cover their ass by finding any reason they can to justify it.
April 17Apr 17 6 minutes ago, Diehardfan said:No, he was ordered not to be deported there but could have been to other countries. That went out the window after the terror designation.Dude. Try to keep up. SCOTUS ruled that all individuals must receive the due process they have a right to receive. It really is that simple and whether he was actually in the gang or not has no impact on those rights. The AEA does not change that as ruled on by SCOTUS.

The only reason he wasn't deported years ago is because some scum judge decided he might be murdered by a rival gang if he got sent home. So just release him here and play Russian roulette with the lives of Americans he lives around. That should be the real scandal.I think if everyone took a step back from partisan politics they'd see the absolute utter absurdity of our government's efforts to keep people like him in the country. Bring him before an immigration judge, review the evidence, and make a ruling. If that is to deport then deport him somewhere. If that needs to be El Salvador then the immigration courts would also need to rule to reverse the ruling that currently doesn’t allow him to be sent to El Salvador. Follow the rules bad guy or not.

April 17Apr 17 https://www.usatoday.com/story/news/politics/2025/04/17/kilmar-abrego-garcia-updates-senator-van-hollen-trump/83135761007/The Maryland senator who traveled here hoping to meet with Kilmar Abrego Garcia, a sheet metal worker who was living in Maryland when he was wrongly deported a month ago, remained steadfast in his efforts to free the father of three. "I've been in El Salvador all day fighting for the return of Mr. Abrego Garcia," Democratic Sen. Chris Van Hollen said in a social media post late on April 16. "The Trump Admin can lie all they want, but the Court said they failed to show he was part of MS-13. This is about bringing home a man they ADMIT should've never been abducted. I won't rest until then."Authorities declined to allow Van Hollen to meet with Abrego Garcia, 29, who is being held in a notorious prison here. Earlier that day, the Trump administration again defended the deportation and appealed a court order to "facilitate" his return to the U.S."If he ever ends up back inside the United States, he would immediately be deported again," White House press secretary Karoline Leavitt told reporters.Leavitt also raised a series of domestic violence allegations against Abrego Garcia from his wife, Jennifer Vasquez Sura. Among them was a restraining order following a domestic dispute between the pair. According to the court order from 2021, Abrego "punched and scratched” Vasquez Sura, "ripped off shirt, grabbed and bruised her.”Vasquez Sura told USA TODAY in a statement that she had acted out of caution after a disagreement in filing the temporary protective order, which was closed a month after she filed it, according to Prince George’s County records. Not everyone barred from visiting prisonAbrego Garcia was sent to El Salvador's Terrorism Confinement Center − CECOT, which has been criticized for its harsh, dangerous conditions. Van Hollen said he spoke with the vice president of El Salvador, Félix Ulloa, and asked for a meeting but was refused. He also said he hasn't been able to access the infamous prison – or even speak to Abrego Garcia by phone. Some U.S. lawmakers, however, had no problem touring CECOT. Republicans Rep. Riley Moore of West Virginia, and Rep. Jason Smith of Missouri posted photos on social media from inside the prison on April 15."I just toured the CECOT prison in El Salvador. This maximum security facility houses the country’s most brutal criminals, including murderers, rapists, pedophiles, and terrorists," Moore wrote. "Several inmates were extremely violent criminals recently deported from the U.S."I leave now even more determined to support President Trump’s efforts to secure our homeland."Smith was dismissive of Van Hollen's efforts to free Abrego Garcia: "It is unconscionable that Democrats in Congress are urging the release of more foreign criminals back into our country."

We truly have evil, malicious rulers. So ICE knew he was a violent scumbag MS-13 member in 2019, and yet didn't appeal the withholding of removal order. Strange..... It's almost as if they knew that the "evidence" they had of him being a gang member was flimsy at best, written up by a detective who was suspended shortly afterwards. And nothing was stopping them from deporting him to another country. If he was the dangerous person the administration claims he is, then why wasn't he deported in 2019?

Garcia is special due to the admin error made by the WH on top of the lack of due process plus he wasn’t deported under AEA. btw - You are aware that Garcia was NOT deported under AEA, right?
April 17Apr 17 Just now, Diehardfan said:It sure seems whomever it was at the DOJ who said they made a mistake was as incompetent as the guy they fired last week. Maybe it was the same person I don't know, but they sure seemed to drop the ball. At the end of the day he got the same due process as the others on that plane and they got it correct despite the efforts of some like Gannon who say they have no proof.Because MS-13 gang members are generally cool with people wearing their colors who aren't members and hanging with them just before being arrested with drugs. The story from TN about trafficking is also something that happens to people who aren't in gangs.for the sake of arguments, i'm going with the thought that this guy should be shipped out. again, just do it the right way and we wouldn't be here right now dealing with this nonsense.

Honestly, this all BS to keep them here.

Citizenship, resident status, etc. all play a part in determining exactly what rights apply to any specific case. What you call "BS" is what protects everyone in the US from the potential tyranny of the state.

And the supreme court reaffirmed that in a recent 9-0 decision. If someone is subject to deportation, they must be afforded the opportunity for judicial review of their deportation order. This isn't new.
