January 26, 20241 yr I don't know a ton about this case, but it's interesting. I understand the SCOTUS ruling that Border Patrol agents must be allowed to reach and access the border, even if that means cutting the wire. Protecting the nation's borders is clearly the responsibility of the Federal Government. So a state blocking US Border Patrol agents from being able to access the border won't work. It seems what should happen is Texas (and other border states) should sue the Biden administration for failing to protect the border, and ask the court for permission to step in since the Federal Government is failing. I bet this SCOTUS would grant that request with the caveat that state officials must allow the Feds to access the border as well. I doubt they would formally transfer responsibility from the Feds to the state. The easy answer would be for Biden to nationalize the guard and then allow them to continue what they are doing, with instructions they must intervene in medical emergencies. But that makes too much sense to happen.

So if Biden nationalizes the Guard, you'd have forces on Biden's orders opposing forces on the governors' orders.

Except that the only proposal so far has been more money for processing immigrants faster. Which is not something many republican or democrat voters actually want. So it's up to the dems to bargain if they don't want republicans to use this to bludgeon the Biden campaign.

The reported deal on the table is Democrats conceding on border policy for Ukraine money. Seems win-win to me. Until the ink dries all we have is conjecture on the details.
