Given what we already know, it is a good bet that the material sought by the committee contains some evidence of wrongdoing. For example, if documents the House has subpoenaed show that Trump or any members of his inner circle intended to delay or hinder counting of the electoral votes on Jan. 6, they would be in violation of 18 U.S.C. 1505. And we already know that Trump and his inner circle discussed how to delay the counting of the electoral votes. See the Eastman memo, which outlined a plan and a legal rationale for overturning the results of the election. Last week, the Senate Judiciary Committee released a report concluding, "In attempting to enlist DOJ for personal, political purposes in an effort to maintain his hold on the White House, Trump ... arguably violated the Hatch Act.”

Trump may very well still try to use lawsuits to run out the clock on these congressional document requests. This strategy likely would not prevent Congress from getting the documents. But it could force a court to rule that there is reason to believe the documents in question include evidence of wrongdoing — a legal lose-lose scenario that any lawyer worth his retainer would be wise to recommend against.

Committee Uncovers Evidence that Trump Concealed Millions in Losses, Hid Debts, and Received Millions from Foreign Governments at Trump Hotel

These documents show:
 

  • Former President Trump Reported Massive Revenues at the Trump Hotel, Concealing that the Hotel Suffered $70 Million in Net Losses.  On his federally mandated financial disclosures, President Trump reported that the Trump Hotel earned him over $150 million in revenue during his time in office.  However, the records obtained by the Committee show that the Trump Hotel actually incurred net losses of over $70 million, leading the former President’s holding company to inject at least $24 million to aid the struggling hotel.  By filing these misleading public disclosures, President Trump grossly exaggerated the financial health of the Trump Hotel.  He also appears to have concealed potential conflicts of interest stemming not just from his ownership of this failing business but also from his roles as the hotel’s lender and the guarantor of its third-party loans.
     
  • While in Office, President Trump Received Preferential Treatment Potentially Worth Millions from a Foreign Bank The documents show that in 2018, Deutsche Bank provided President Trump with a significant financial benefit by allowing him to delay making principal payments on the Trump Hotel’s $170 million loan—which Trump had personally guaranteed—for a period of six years.  Without this deferral, the hotel may have needed to pay tens of millions of additional dollars to Deutsche Bank at a time when it was already facing steep losses.  Mr. Trump did not publicly disclose this significant benefit from a foreign bank while he was President.
     
  • The Trump Hotel Received Over $3.7 Million from Foreign Governments Based on the Committee’s analysis, from 2017 through 2020, the Trump Hotel received an estimated $3.7 million in payments from foreign governments, raising concerns about possible violations of the Constitution’s Foreign Emoluments Clause.  This amount would have been sufficient to cover over 7,400 nights at the Trump Hotel at the average daily rate.  Former President Trump failed to disclose details about these payments to GSA, and he "donated” to the Treasury only the small portion of these payments that his company determined to be profits.
     
  • Former President Trump Concealed Debts When Bidding on Old Post Office Building Lease In 2011, when he applied to lease the Old Post Office Building, former President Trump provided GSA with financial information that appeared to conceal certain debts.  Specifically, he provided a 2008 financial statement that reported over $1.1 billion in outstanding loan balances for properties in Chicago, Las Vegas, New York, and San Francisco.  Although these loans remained outstanding in 2009 and 2010, President Trump omitted them from his financial statements for those years, hiding key information.
     
  • The Trump Hotel Moved Around Millions of Dollars in Opaque Transactions with Other Trump Businesses.  President Trump transferred millions of dollars in and out of his D.C. Hotel through affiliated entities and opaque transactions, raising questions about GSA’s ability to enforce provisions that prohibited President Trump from taking money out of the business.

Judge orders Trump to sit for a videotaped deposition in case involving protesters who say they were assaulted at a MAGA rally

  • State Supreme Court Justice Doris Gonzalez ordered Trump to sit for the deposition next week.

A judge in New York ordered former President Donald Trump to sit for a videotaped deposition on Monday as part of a civil case filed by protesters who say Trump's security guards assaulted them at a September 2015 rally.

On October 4, State Supreme Court Justice Doris Gonzalez ordered Trump to sit for a deposition, which is scheduled for October 18 at 10 a.m. at Manhattan's Trump Tower. Trump's attorneys agreed to the date in a stipulation, court records show.

The lawsuit was filed in 2015 by a group of Mexican protesters who say they were attacked outside Trump Tower at the rally, three months after Trump announced his bid for the presidency. It was gummed up in courts during Trump's presidency, as Trump argued he should receive immunity from testifying, but is now headed to a trial, according to Benjamin Dictor, an attorney representing the protestors.

"After defendants spent years unsuccessfully fighting to keep Donald Trump from testifying under oath, we will be taking his testimony in this case on Monday," Dictor, an attorney at Eisner, Dictor & Lamadrid, told Insider. "We look forward to presenting this case, including Mr. Trump's video testimony, to a jury."

The suit named Trump, the Trump Organization, the Trump campaign, Trump's former head of security Keith Schiller, security guards Gary Uher and Edward Jon Deck Jr., and two others who were identified as John Doe 3 and 4 as defendants.

Attorneys for the protestors subpoenaed Trump in the case, arguing in court filings that the guards attacked the protestors as part of their official duties, citing Trump's comments at election rallies where he has encouraged violence against hecklers. The deposition could be shown to jurors at a trial, according to Dictor, who is also an attorney for the NewsGuild of New York, which represents Insider Union members.

Trump's attorneys asked judges to quash the subpoena, and the case moved slowly through the appeals process. But after Trump left office earlier this year, a New York state judge dismissed the arguments as moot and moved the case forward.

Trump faces numerous civil lawsuits, many of which are progressing now that he is no longer president. Earlier in October, another New York state judge ordered Trump to sit for a deposition before the end of the year in a lawsuit Summer Zervos brought against him over sexual misconduct claims.

Was thinking he can claim executive privilege but now seeing it was for something in 2015. Not sure if that's still valid or not since it preceded his time as president. Either way, I'm not sure if there's much risk here if they have to depose him for something that happened at a rally.

He's no longer President. He does not have the right to claim Executive Privilege. I am looking forward to him lying under oath and being charged with Perjury.

There are no clear answers on the ability of a former president to assert privilege, but there are some principles and precedents to guide the inquiry. The most famous case on executive privilege is United States v. Nixon, in which the Supreme Court ordered President Nixon to disclose the White House tape recordings about Watergate. But, in an often-overshadowed second privilege case involving Nixon, Nixon v. Administrator of General Services, the court held that Nixon, as a former president, had standing to assert executive privilege. The case arose out of a fight for access to the documents and tape recordings of Nixon’s tenure in the White House.
