Moment of Truth in Trump Case After ‘Extraordinary’ Late Night Legal Battle

A U.S. appeals court is expected to rule shortly on whether Trump attorney Evan Corcoran can appear before a grand jury in Donald Trump’s Mar-a-Lago classified documents case.

The move comes after a dizzying saga overnight, in which the U.S. Department of Justice and attorneys for Trump filed dueling motions over Corcoran’s testimony. At the heart of the battling motions is a Friday ruling in which a federal judge reportedly sided with the DOJ, finding that Corcoran could be compelled to testify because prosecutors had sufficient evidence Trump may have used one of his defense attorneys in an alleged bid to mislead investigators.

Attorneys for Trump have fought that ruling, and the D.C. Circuit Court of Appeals on Tuesday gave them until midnight to specify which documents are at issue. The DOJ, in turn, was ordered to file its response by 6 a.m. Wednesday.

Jack Smith, the special counsel appointed by the Department of Justice to investigate Trump’s potential mishandling of classified documents, has requested that Corcoran appear before the grand jury in the obstruction probe. Smith found "compelling preliminary evidence” that the former president knowingly misled his own legal team about holding onto the records after leaving office, sources told ABC News on Tuesday.

Georgia though... those charges could be much more serious.

Your honor, my client has committed so many crimes. It seems petty to indict him for this particular one.

If we really want "justice", you go after him for every law he has broken, no? Why would arresting him on these charges make it impossible to get him on others? People are convicted of crimes while serving time for others all the time.

Seems to me the easiest crime to charge Trump with would be Mail Fraud, Wire Fraud. Fundraising for one stated purpose like a legal defense fund after the election is over, never creating the fund, and then Trump takes the money raised and uses it for his own personal purposes. The fact he hasn't been charged is beyond me.

Bannon was charged for it and Trump pardoned him.

Wire fraud is punishable by up to 20 years in prison, and can result in a fine of up to $250,000.

One thing of note it that it is very very odd to have a judge both demand a filing of documents w/i a two hour window and have only in by midnight. 

Every judge I have ever dealt with has been very "meh” about a timeline. 
 

So I’m guessing there may be some kind of national security implication.

I have never seen deadlines set at midnight and 6am. Kinda nuts.

Not typical for sure. Pretty clear the Court of Appeals is going to uphold the District Court Order. Corcoran is going to have to testify.

In a perfect world criminals are indicted and convicted of all crimes they're guilty of. 

The practical reality here is that the NY indictment is going to be very very heavy on effort and desire to "nail" Trump for a crime that ultimately will end up being a fine. He's almost certainly never going to do prison time for what NY is trying to convict him for. 

All of which will feed into the narrative that it's a politically motivated prosecution. Which is probably the truth in NY. 

But Georgia is the real ish. Nail him on that and you're talking serious criminal justice.

Right, but they also aren’t charged for every crime they commit. They get charged for the ones with the necessary evidence and the biggest bang for the buck.

Don't think there's much chance of that happening.  Primaries start in less than 10 months.  No way it's all wrapped up by then.  And even if it somehow were, he'd still run (and win) the primary from prison.

I get that. But let's say he's found guilty of everything NY is charging him with. How does that prevent him being tried for committing crimes in Georgia? Or all the other places he likely broke the law?

if this indictment happens, i fully expect trump to win 2024. nothing will fire up his people quite like being the underdog, being the victim, being told that the establisment is against them. hes a world class spinster, and an indictment just gives him fuel to spin.
