He loses at District court, he can appeal to Circuit Court of Appeals. Lose there, file writ to SCOTUS. But they hear less than 1% of cases that file writ. Going direct to SCOTUS is an extreme remedy for injunctive relief. He has no case for that here. If his lawyers filed some emergency brief to SCOTUS, it would be denied almost immediately. So it will take years through the system.
August 4, 20232 yr Thinking about this, I guess an insane plan could be to file a motion to stay the trials until after the election. To get a stay/injunction, you need to demonstrate irreparable harm. I guess he'd argue that by allowing the trial to take place during the Presidential election, he would suffer irreparable harm if it cost him the election. No court would grant it. None. You don't have a Constitutional right to run for President. Furthermore, if he loses in 2024, he'll announce his 2028 run the next day to have the same argument. The idea that any criminal defendant could simply announce a run for office to avoid prosecution is insane. And then people would stretch the precedent -- I'll suffer irreparable harm if I miss work and don't get a promotion. But this moron might try it and get rejected.
