Thinking a bit more, I do think it will come down to this single question and more importantly who gets to decide.  If SCOTUS sides with Colorado then they will have determined that each State can decide.  I don't think they will do that.  Instead, I think they will rule against Colorado essentially determining that this is an item that will be decided by the federal govt.

From there it can go in a couple different directions for Trump.  Ultimately, Congress could pass legislation essentially defining the term and then a case could later be brought thru the courts to SCOTUS challenging such law.  That scenario is unlikely to be in place during 2024 which leaves the DOJ trial as another immediate option to decide regarding Trump.  Again, any result from that trial would ultimately be appealed to SCOTUS and that process is unlikely to finish in 2024.  The final scenario is the one you point out where we get there quicker due to a Trump victory and subsequent challenge to his right to hold the office of POTUS sometime during H1 2025.

No doubt we end up at SCOTUS no matter the scenario in regards to Trump and that includes a Trump loss as he will throw that scenario back to the courts with the claims of rigged elections.

Fun times ahead.

JFC either his legal team is just going through the motions or they are straight up stupid. 
 

The only time you can skate on something malum prohibitem while ignorant about it is if the act was a passive one, which obviously his wasn’t. 
 

I hate this late 19th century ish we’ve devolved into. Reconstruction didn’t go far enough.
