That’s not analogous at all to this situation. Nor did I ever say that states have to wait until the USPS starts ENFORCING new mail in ballot rules before states can sue. What I very clearly said is that there has to be a published provision for states to bring a suit against in order to claim harm. Otherwise the only evidence for their harm is what they THINK the final provision might say. You can’t say a regulation violates the constitution when there isn’t even the regulation hasn’t even been created yet.

My opinion is backed by plenty of precedence.

Can you provide an example of when a plaintiff successfully sued the government over the instruction to draft a proposed rule?

There is no law and only an EO. None the less SCITUS should have not expedited this first one. All of it is a red herring since the real case is coming shortly which will be on the merits.

Correct the provision has been published and has been challenged. And additional challenges are coming as well. I expect an injunction will be issued the first or 2nd week of September. And I expect the government to then lose the case.

The upcoming SCOTUS ruling on the mail in ballot EO is the biggest test yet in terms of how far SCOTUS will allow Trump to go. Time for them to say "you’ve gone too far already” thus sending a message with regard to the other Trump election shenanigans that are sure to follow.

Yup. Should be DOA. Though wouldn't surprise me if 1 or even 2 of the justices voted in favor of the government's side. I thought the birthright citizenship case would be 8-1 at worst and that didn't happen.

Thomas and Alito basically never vote against Trump. So expect those 2 to uphold the law, while the 3 liberals vote against Trump.

Roberts, Comey Barrett, Kavanaugh and Gorsuch - those are the 4 conservatives that could reject Trump. The order listed is my guess on the likelihood they rule against the President.

I'll say 6-3, EO is defeated.

I've lost all faith in Gorsuch. We've also seen Kavanaugh make some questionable judgements too, so a 5-4 split would not shock me in the least.
