Well, the thing is, he legally couldn’t. 
 

Gun rights activists are laughing their a**es off this week because of the NM governor getting dunked on, CA getting their amendment dunked on in court, and now Hunter getting indicted for something that, contrary to people posting on Twitter, people have been indicted for in the past. 
 

The thing about the last one is that the 5th Circuit ruled the marijuana use prohibition on gun ownership as unconstitutional. So you have the Biden administration arguing in court that it is in fact constitutional, while Hunter has been charged with it (in addition to being on crack at the time, but hey). 
 

It’s one of the things that ticks off gun rights activists. Gun control activists keep pushing for new laws, while gun rights activists point out (correctly) that the laws that are already on the books aren’t being enforced. The fact that you have liberal prosecutors saying that "I’ve never charged anyone for this, it’s a reach” is Exhibit A. It’s a law and it’s on the books. You’d be amazed at how many prohibited possessors are caught in possession of firearms but they don’t get charged for it.

I firmly believe that every law not enforced weakens every other law.

The Justice Department's chief tax prosecutor has told Congress that Delaware U.S. Attorney David Weiss could not bring tax evasion charges against Hunter Biden without getting prior approval from his office, further undercutting Attorney General Merrick Garland's portrayal that the politically sensitive probe was completely independent.
