I'm not sure if it was adopted by a majority or supermajority, but essentially the process was the same. I'll admit the situation is very dicey. Eminent domain is hugely controversial, and for good reason. I'm just trying to show that the move wouldn't be entirely unprecedented. I side with the Libertarians on this one (and not just because I'm invested in Pfizer, though that does play a part in it). There's always going to be an "unprecedented" situation that gives one side the green light to bend the rules (and remember, both sides have very different ideas of what is an immediate threat). At the very least, the administration should wait to really implement this until these other countries actually need the patents to be released. It sounds like right now the issue has absolutely nothing to do with that, it's about them not having the raw materials to even attempt it.

I don't think the government needs, or should be, involved. To be clear, I don't think that's what's happening. Trade secrets aren't being force to be divulged, the US government is merely saying they won't enforce existing IP protections for covid vaccines. As for your comment on Salk, from what I've read, he was an unsavory character that merely gave the appearance of being noble. Allegedly he had a team of patent lawyers investigate filling for patents, only to be informed most of the work wouldn't qualify or already existed. Only then did he act like he always intended for his work to be available for broad use.

May 6, 20214 yr Author I haven't come down strongly one way or the other on the issue. I think there are good arguments on both sides. More or less, I'm playing devil's advocate here and trying to keep an open mind.

Very true, but in a legitimate crisis, sometimes you do need to do extraordinary things. Again, I go back to WWII. We couldn't have won if we didn't accept that we had to accept a level of intervention/regulation that we would normally find repugnant. The problem, though, which you point out, is that the concept is abused, like with the Patriot Act. Politicians have cried wolf so many times before that it's easy and natural to reject any attempt to do so as another power grab. I just fear that, when legitimate crises do arise that require deviation from our norms, that we will fail to recognize the uregency of the moment and be unwilling to take the uncomfortable but necessary actions to handle them. I just want to be able to get the job done.

Only then did he act like he always intended for his work to be available for broad use. I know there's some question around how noble or not Salk's decision was, but from the team he worked with the intent to make it publicly available. https://slate.com/technology/2014/04/the-real-reasons-jonas-salk-didnt-patent-the-polio-vaccine.html There is an important footnote regarding Salk’s statement that "there is no patent.” Prior to Murrow’s interview with Salk, lawyers for the National Foundation for Infantile Paralysis did look into the possibility of patenting the vaccine, according to documents that Jane Smith uncovered during her dive into the organization’s archives. The attorneys concluded that the vaccine didn’t meet the novelty requirements for a patent, and the application would fail. This legal analysis is sometimes used to suggest that Salk was being somewhat dishonest—there was no patent only because he and the foundation couldn’t get one. That’s unfair. Before deciding to forgo a patent application, the organization had already committed to give the formulation and production processes for the vaccine to several pharmaceutical companies for free. No one knows why the lawyers considered a patent application, but it seems likely that they would only have used it to prevent companies from making unlicensed, low-quality versions of the vaccine. There is no indication that the foundation intended to profit from a patent on the polio vaccine.

From what I'm hearing, when Biden mentions Corn Pop it means the storm's coming and Trump is about to be arrested. And of course it does, it's so obvious. The signs have been there all along. Corn was grown by the Native Americans, who were killed or imprisoned by early settlers. Pop obviously refers to the Founding Fathers (Father = Pop), so Lord Biden is telling every patriot that Trump will soon be arrested (imprisoned [Corn])) for his crimes against the Constitution (Founding Fathers [Pop]). I'm honestly embarrassed that it took me so long to realize this, because it's been staring us in the face the whole time. The important thing is that we trust the plan.
