    Hey everyone.  Im still in the hospital.  No ventilator.  No visitors.  Breathing treatments multiple times a day. Chest xrays every other day. Pulse oxygen is 89% with a nonrebreather mask running fu

  • Update  Surgery was a success. Mom has been home since this afternoon. Some pain, but good otherwise and they got the entire tumor.  Thanks all for the well wishes and prayers.

Good times.

People should have been discouraged from going out entirely.  However, if they were going out there was absolutely no reason to selectively avoid asian restaurants and grocery stores at that time.  Especially now that we know most of the spread from the East coast was back and forth with Europe.

Not supporting a ban on travel back and forth from China on the other hand was absolutely a huge mistake by several prominent democrats.

A. The federal government doesn't have the authority to mandate mask wearing

B. Even if they did mandate it, how would they enforce it?  Are we now going to have to police every idiot out there who doesn't wear a mask?

Of course I wear a mask and so does everyone else.  If states want to mandate it and enforce it that's fine, but the Fed has no authority or ability to mandate this.

The way the Federal Government gets around this is by forcing states to do it by withholding money. It's why we have a "national" drinking age of 21. The Federal Government can't mandate such a thing, but they put provisions into the Highway funding bills that would withhold funding from any state that didn't make 21 its drinking age. They could do something similar and withhold funding for other programs unless a state mask mandate is in place -- like money from the next stimulus targeted for state and local governments.

I don't like agree with it, but that's how it gets done.

same goes for education, and everything else pretty much. the federal government draws tax revenue from states and redistributes it, and through that it wields more power than it was designed to within the framework of the constitution.

I think it's worth discussing the merits of how our government is constructed in this day and age vs 1787, but those are difficult discussions that threaten existing power structures. 

for example, I think there's an objective rationale for trying to standardize in some way the curriculum received by students across the nation. as someone who was reasonably educated on the Civil War, history of reconstruction, the impacts of Jim Crow legislation as well as the legacy of them even after the Civil Rights act, I have found it absolutely unconscionable that there are regions in our nation that teach the Civil War as "the war of northern aggression" and that slavery was some sort of tangential "side issue"*, teach Jim Crow either not at all or barely touch on it, sometimes even skip over the entire fight for Civil Rights (and of course why it was necessary)**

I'm generally at least skeptical of trying to standardize things across the nation, but if we have people that aren't even operating from the same basic set of facts about our own history how can we be a people united?

Sure.  And if Trump did that Democrats would scream that critical state services would go without funding because the federal government was withholding funding to force something that was unconstitutional.

We live in a Republic.  States have more power than the Fed in most cases.  For this reason wearing masks is not a national issue.

My point is that, no president can make an impact here.  Take Trump out of it, the Republicans would do the same thing if Biden was in office.  Either you...

A. Do not mandate masks at the Federal level and allow the State leadership to manage it themselves.  In this case, your opponents response would be that you are failing to provide national leadership (as many have said in this forum).

or...

B.  Create a federal "mandate" and engage the federal government in the quagmire of trying to hold states accountable through withholding funding or some other means.  Here, your opponents say that you are overreaching and pushing an unconstitutional mandate.  

Its a total dam*ed if you do, dam*ed if you don't situation...which is why I said earlier that I was fed up with the topic.
