Oath Keepers' lawyer arrested in connection with Jan. 6

A lawyer for the far-right Oath Keepers extremist group has been charged with conspiracy in connection with the Jan. 6, 2021, attack at the U.S. Capitol, authorities said Thursday.

Kellye SoRelle — general counsel for the antigovernment group — was arrested in Texas on charges including conspiracy to obstruct the certification of President Joe Biden's electoral college victory, the Justice Department said.

New Mexico bars commissioner from office for insurrection

 

SANTA FE, N.M. (AP) — A New Mexico state district court judge has disqualified county commissioner and Cowboys for Trump cofounder Couy Griffin from holding public office for engaging in insurrection at the U.S. Capitol on Jan. 6, 2021.

State District Court Judge Francis Mathew issued a ruling Tuesday that permanently prohibits Griffin from holding or seeking local or federal office.

Griffin was previously convicted in federal court of a misdemeanor for entering Capitol grounds on Jan. 6, without going inside the building. He was sentenced to 14 days and given credit for time served.

The new ruling immediately removes Griffin from his position as a commissioner in Otero County in southern New Mexico.

"Mr. Griffin aided the insurrection even though he did not personally engage in violence," Mathew wrote. "By joining the mob and trespassing on restricted Capitol grounds, Mr. Griffin contributed to delaying Congress’s election-certification proceedings.”

Griffin he was notified of his removal from office by Otero County staff, who prevented him from accessing his work computer and office space at a county building in Alamogordo.

Griffin, who served as his own legal counsel at a two-day bench trial in August, called the ruling a "total disgrace” that disenfranchises his constituents in Otero County.

"The actions that are being taken are, I believe, are perfect evidence of the tyranny that we're right now living under,” Griffin said. "The left continues to speak about democracy being under attack, but is this democracy? Whenever you're removed from office by the civil courts by the opinion of a liberal judge.”

The ruling arrives amid a flurry of similar lawsuits around the country seeking to punish politicians who took part in Jan. 6 under provisions of the 14th Amendment to the U.S. Constitution, which holds that anyone who has taken an oath to uphold the Constitution can be barred from office for engaging in insurrection or rebellion.

Ratified shortly after the Civil War, the provisions were meant in part to keep representatives who had fought for the Confederacy from returning to Congress.

The FBI should arrest them and charge them all under the RICO statute. This organization is ready to take over, after Trump declares himself President for Life.

The names of hundreds of U.S. law enforcement officers, elected officials and military members appear on the leaked membership rolls of a far-right extremist group that's accused of playing a key role in the Jan. 6, 2021, insurrection at the U.S. Capitol, according to a report released Wednesday.

The Anti-Defamation League Center on Extremism pored over more than 38,000 names on leaked Oath Keepers membership lists and identified more than 370 people it believes currently work in law enforcement agencies — including as police chiefs and sheriffs — and more than 100 people who are currently members of the military.

It also identified more than 80 people who were running for or served in public office as of early August. The membership information was compiled into a database published by the transparency collective Distributed Denial of Secrets.

The data raises fresh concerns about the presence of extremists in law enforcement and the military who are tasked with enforcing laws and protecting the U.S. It’s especially problematic for public servants to be associated with extremists at a time when lies about the 2020 election are fueling threats of violence against lawmakers and institutions.

With a single RICO charge, a federal prosecutor can indict multiple members of a criminal organization, from minor players to the top shot callers, on a multitude of crimes, including crimes that were not committed by the named defendants.

Crimes could include, Conspiracy, Assault and Battery, and Larceny.

Not if it isn't proven that the specific members committed a criminal act specified in RICO, and even then it requires proof of conspiracy to tie others to those predicates. 

Being listed as a member in a spreadsheet isn't enough man. We're not living in a banana republic.

Federal prosecutors have subpoenaed a former aide to ex-President Donald Trump in the Justice Department's investigation into the Jan. 6 Capitol riot, The New York Times reported.

FBI agents in Florida are seeking to interview William Russell, who served as a special assistant and the deputy director of presidential advance operations in the White House under Trump, and continued working for him after he left office, the article said.

According to the Times' sources, agents have not not yet interviewed Williams, but are seeking to do so in relation to their investigation into the riot on January 6, 2021, when a mob of Trump supporters attacked the Capitol in a bid to halt Joe Biden's certification as president.

The move indicates that the FBI is moving closer into Trump's inner circle as it investigates the riot.

Until recently it was unclear if the Justice Department investigation touched on Trump himself.

But Pat Cipollone, who served as White House counsel to Trump, recently gave an interview before a grand jury convened in the probe.

The FBI is reported to be focussing on a scheme to appoint a set of fake electors to the Electoral College in 2020, who would've ignored the actual result of the election and instead cast their votes for Trump. The plan was backed by officials close to Trump.

The House Jan 6 committee is pursuing a parallel investigation into the January 6 riot, and has focussed closely on Trump's involvement in the scheme to overturn the result and his actions on January 6, when he delivered an incendiary speech to supporters then watched them ransack the Capitol on TV.

Trump also faces legal peril from the FBI's investigation into his possession of government records, including highly classified information, that was recovered in a raid on his Mar-a-Lago resort in Florida in August.
