Jan. 6 panel obtains emails ex-Trump lawyer tried to shield

The House select committee investigating the Jan. 6 attack is reviewing a trove of emails that John Eastman, the ex-lawyer of former President Trump, had tried to keep secret, federal court documents filed Tuesday show.

 

  • The emails purportedly show Eastman and other Trump aides discussing various methods to bar Congress from certifying the 2020 election results, including weaponizing the courts.

 

What they're saying: "This may have been the first time members of President Trump’s team transformed a legal interpretation of the Electoral Count Act into a day-by-day plan of action,” Judge David Carter wrote in court papers last month.

  • He added: "In another email thread, Dr. Eastman’s colleagues discuss whether to publish a piece supporting his plan, and they touch on state lawsuits only to criticize how they are being handled by the Trump campaign."

  • "In a different email thread, Dr. Eastman and a colleague consider how to use a state court ruling to justify Vice President Pence enacting the plan. In another email, a colleague focuses on the ‘plan of action’ after the January 6 attacks.”

Donald Trump says he regrets not marching to the Capitol on Jan. 6, and once again tried to blame House Speaker Nancy Pelosi (D-Calif.) and Washington, D.C., Mayor Muriel Bowser for the violence, according to a new interview with The Washington Post.

"Secret Service said I couldn’t go. I would have gone there in a minute,” Trump claimed in the interview, adding that he isn’t getting the credit he deserves for the amount of supporters of his who showed up.

Once Trump was back at the White House and became aware of the violence at the Capitol, he told the Post he thought it "was a shame.”

"And I kept asking why isn’t she doing something about it?” he said. "Why isn’t Nancy Pelosi doing something about it? And the mayor of D.C. also. The mayor of D.C. and Nancy Pelosi are in charge. I hated seeing it. I hated seeing it. And I said, ‘It’s got to be taken care of,’ and I assumed they were taking care of it.”

Trump has been attempting to shift responsibility to Pelosi and Bowser for more than a year now. In a chummy interview with Sean Hannity in January, he repeated the debunked claim that Pelosi "turned down” the National Guard he summoned, and insisted that "we would have had no Jan. 6 as we know it” if not for her and Bowser.

 

Trump also insisted to the Post that there is nothing suspicious about the seven-hour gap in his White House phone logs last Jan. 6. The former president, who may have violated the Presidential Records Act, claims he didn’t destroy any call logs or speak on "burner phones.” But he said he did remember talking to House Minority Leader Kevin McCarthy (R-Calif.), Rep. Jim Jordan (R-Ohio), and others during that time.

"From the standpoint of telephone calls, I don’t remember getting very many,” Trump said. "Why would I care about who called me? If congressmen were calling me, what difference did it make? There was nothing secretive about it. There was no secret.”

    A former federal prosecutor believes Ivanka Trump's testimony to the House committee investigating the Capitol riot "incriminated" the former president.

    Her testimony likely included the revelation that she was present at the White House during the riot and tried to get her father to call off his supporters, former federal prosecutor Glenn Kirschner said on Friday on "The Stephanie Miller Show."

    But Trump refused, according to former Trump national security advisor Keith Kellogg, Kirschner said.

    Kirschner said several people, including former White House press secretary Kayleigh McEnany, "tried and failed" to stop him.

    "Ivanka tried and failed, so we sent her back into the Oval Office a second time because she can be pretty tenacious, and she couldn't get her father to stop the attack on the Capitol," Kirschner said, citing Kellogg.

    "That is a president in a very real way, waging war against the United States," Kirschner said. "Even his own daughter couldn't stop him. That is deeply incriminating information. Presumably, it's been provided by Ivanka under oath to the J-6 committee, and if I were prosecuting the case, she would be one of the very early witnesses I called."

Trump in previous remarks had called the insurrectionists who stormed the Capitol "political prisoners.” He also indicated at a Texas rally early this year that if he’s ever reelected president, he would pardon many of them.

"We will give them pardons because they are being treated so unfairly,” he said.

After resisting for months, Stephen Miller is slated to appear before Jan. 6 Committee today. I guess he figured prison isn't worth it.
