I see they're beginning demonize the victim, they're spinning it to where he was the aggressor and he walked into a home under construction among other things.

Concerning walking into a home under construction, I've done that several times.

I’ve walked into a few homes under construction recently, one of which had no exterior doors yet, but the builders had just put in a walk-in refrigerator in the kitchen.

Yea people are scumbags.

I've walked into several homes that were under construction because I'm nosy AF and always want to have the goods on my neighbors.

Yeah in Florida trespassing onto a construction site is a felony.

It's not your house. Stay the F out.

(I'm not using this to say that the shooting was justified. It was not a justifiable homicide.)

It’s not your house until you get the CO. Unless you’re building, or appraising for draws, there’s no reason to be there.

I heard on the radio today that it turned out that it wasn’t even him that went into the construction site.

a lot of builders put up a chain-linked fence is what I've noticed in my neighborhood.  It's not possible on every jobsite though.

It's only a felony if you bring a firearm onto the construction site. And if you dont, there needs to be a clearly marked sign saying it's a felony.

Doing what Arbery did in FL would have been a simple misdemeanor.

I wouldn't be surprised. But I'm operating under the assumption it was him.

Is there any kind of statement that you’re supposed to shout out prior to making the Citizens arrest?

I initially misread this. This is correct. It’s a felony if you have a gun on the site and it’s  also a felony if there’s a sign posted that it’s a construction site and you’re there....with or without gun.

"Hi-Yo Silver"?

I will say this much, Arbery's response was not the way to go, if someone approaches me with a shotgun, my hands are in the air and I'm trying to de-escalate  the matter, the last thing I would do is begin tussling for the gun.

Truth be told, the incident seems unreal, especially when you take into account that the rednecks go two months without being arrested and had the video not come out who knows if they would have ever been arrested.

Seems fishy to me.

What is it with posters on this board walking around construction sites? Lol. Bobby wizdum claimed to have gotten brutally beaten by  cops for being near a construction zone ....

I haven't taken the time to learn FL laws because it's already a wasteland, so I can only speak to PA laws.

In order for a person to make a citizens arrest, the crime committed has to be a felony, the citizen has to witness the crime, and the person commiting the crime has to be the one that is arrested (you'd think the last point is redundant but you'd be surprised). If the felony criteria isn't met, it has to be some type of offense that causes danger to someone (for example, if a guy starts punching people, it's either summary harassment or misdemeanor simple assault if there's an injury, but you can go ahead and detain that guy). Then when the guy is "arrested" you pretty much have to immediately notify the police.

If you shoot the person dead does that count as a citizen arrest or no?

I've only done it when I'm building a house in a neighborhood with other people who are also building at the same time.

If you hit them in the heart it might count as a cardiac arrest.
