Will it work? Not with this Court. But it's a better line of argument then what Justice Blackman wrote. RBG's argument is clearly a Constitutional based one. It will also get an Intermediate Scrutiny level of review because women are not a Suspect Class, like Race and Religion. I'm sure there will Court challenges about this decision. Just like Red States did while it was legal.

May 3, 20223 yr Reminder, not every pregnancy to term results in a happy, healthy child. Instead of having pro-life/pro-choice marches, walks, and fundraisers… We should be doing it for prenatal and medical care. Everyone should agree. If this mother had had access to prenatal care, 21st century medical advances would have found the lethal abnormalities. She would have had enough time to put the baby up for adoption.
