That's a fallacy.  Separation of church and state is policy, but it's not in the Constitution.  The Bill of Rights provides for freedom of religion.

So, a friend of mine's father in law ended up getting cuffed today when he went to vote because he was all decked out in his political gear and was asked to change to come in to vote because of state law (this was in Colorado), and he refused and got belligerent toward poll workers. The video I saw of it, he kept muttering about "my freedom of speech"
