I'm sure there's a line. Like if he went online and said "Hitler was the best!" full Kanye style, I'm pretty sure he could get fired. I doubt calling a piece of garbage a piece of garbage is over that line but they hired an arbiter so let him do their job. The opinions of sailing team captains Thad, Chad and Brad means exactly nothing here and the sob story about being influenced by this evil teacher is laughable.

You need to check the collective bargaining agreement. We don't know what's in there. There could be a personal conduct clause giving the school district the right to dismiss the teacher for certain types of violations.

First I would suggest you read the first amendment and learn what you are and are not protected from.

If she can prove the federal government terminated her she might have a case.

I doubt it. He was suspended not terminated. His ratings were trending along with the other two, and that isn't an upward trajectory.

He wasn't even suspended for what he said. He was suspended for threatening to go farther the next evening. The affiliates were down with it and his employer said "enough".

Nielsen ratings, on average, are down across the board for all genres and show types. They've largely been unable to accurately assess streaming viewership in their process. Kimmel might still be below the overall downward trend but it's not as dramatic as implied by the graphic once you compare it to all other shows (especially the most direct competitors.)

And for those who think streaming is still small potatoes and Kimmel was struggling with online viewership, I suggest you compare his subscriber and total views count on his YouTube channel with right wing media darling Joe Rogan's.

As for your point about Youtube viewership, that's really irrelevant. Perhaps it points to a degree of popularity not reflect in Nielson ratings, but from ABC's perspective, so what? That doesn't help the network.

Bottom line, all three late night shows are in decline, but Kimmel's decline - from a ratings perspective - was the steepest. Perhaps the answer for a guy like Kimmel is to switch solely to a streaming or online presence like others have done. However, that would entail a considerable amount of expense on his part since he would bear the cost of producing his show online unless he could find backers.

No it doesn't. It's freedom of speech not freedom from consequences for what you say.

Also consider there are discussions boards like this and social media where you go for attention. She wanted attention and got it.

Procus, while being thoroughly retarded in almost all other matters, is correct in that their CBA may have dictated that personal conduct outside of school hours (in a public setting, like what you post on the internet) which is damaging to the school's reputation, may possibly result in termination. There are many cases since the dawn of the internet where this exact sort of thing has been challenged and upheld.

Now obviously there is a line on what can be viewed as "damaging" and a violation of district policy, like the one teacher who put up a poster saying "All students are welcome" would almost certainly win if she had fought it instead of resigning. And in this case, it might be a tough sell that calling someone as controversial as Charlie Kirk a piece of trash, would be a violation as well, but it's not a forgone conclusion that it would be found as a wrongful termination in court.
