It really is hard to tell where the majority sits. While true, the Democrats basically sat on their hands for 50 years and never made a serious attempt at a legislative remedy. Relying on a SOCTUS ruling that rested on shaky legal ground was always risky. Not that a law would've been bulletproof, but it would've at least provided some reinforcement. The party has been terminally weak-willed for several generations. Say what you want about Republicans, they play to win.
