Lets say you get a building permit for a detatched garage. Approved, have the permit since September.

You start excavation and have it framed out to pour concrete. Now township comes and says you cant put it there. When they already approved it to go there.

After about $20k already in to the project now have a work stop order. Hearing scheduled, not till 12/20.

What sort of recourse is there, if any?

 

I would talk to an attorney in the area.  Typically there's not much in the way of recourse for delay costs or probably a complete revocation against a municipality.  I would imagine they have to some specific reason to revoke it.  I think it's typically when they maybe do an inspection and see something is not built to code.  If you have a licensed contractor and they are not building it to code, you should have recourse against them.

I have some experience with fighting townships getting variances to build homes.  Not to be negative, but it's almost impossible to fight city hall.  You might get the approval after approaching that $20k in legal fees.  Worst case is that you lose the 20k in the project.  The town will have some fine print reason for why the permit was issued but the current construction isn't OK.  I wouldn't expect an "oh, we gave you a permit, sorry about the confusion."

Back story.

Some lady had a bad experience with our builder. She was refusing to pay for upgrades/changes she requested. He left the job unfinished because she stopped paying. He told her to find another contractor to finish and stopped responding to her.

She saw him at our house beginning to work.

She reported our house, twice apparently. Saying we didnt have permits. We did, and they have been displayed in our window since construction began.

Shes just trying to make life miserable for the builder and hurt his business. We are pawns to her.

 

Our structure is under 1000sqft. There was supposed to be no inspection under 1000sqft. However, I guess since the guy had to come out, he measured and said we are not far enough from the road.

 

We are approved at 20 ft. Which was written in one of their rules. However I guess the guy at the office that approved us did not have a 2nd paper that had another article in it stating that due to a corner lot, our setback on this side of the house has to be the same as our setback in the front. Which is actually 35 ft. Not 20.

Incidentally, when measuring, the guy found that our frame for the pour is actually only 18.5 ft from the road. I have no idea how they screwed that up.

 

All along he actually has been saying its their mistake. He will work with us. They just have to create a paper trail to show this has been contested so that not everyone can go breaking this rule in the future. There was supposed to be a 500 dollar variance that they are supposedly waiving. Has stated numerous times the garage will be built where it is planned, we just have to go through this stuff seemingly as a formality for them to create the paper trail.

HOWEVER, today they had a meeting with my builder. And still imposing the work stop order (wouldnt have expected that if they were trying to work with us). And are making us wait for a hearing on the 20th. And the guy (who said he was going to work with us and everything would be ok) is being a stickler about the 18.5ft (which wasnt even the reason he came out and never should have been inspected due to our square footage). This is like his gotcha moment. I think we can easily move the wood frame 1.5 ft to where it should be, but Im not even sure if they can do that with the work stoppage order. Their offer to us was that we can continue with the build if we signed a paper that says the twp. is not responsible if they decide to come tell us to fix it. Obviously we are not doing that. Thats their way of telling us to stop and putting the entire lost cost on us.

Its just craziness...

theyre saying we were acutally supposed to be 35 ft. from the road. They approved us at 20ft from the road.

at this point with how corrupt everything is, I'd just bribe them. 

yeah. we were on the up and up. We went to them with all the information. They approved it and gave us the permits. 

 

I was just informed they are allowing us to move the frame 1.5 ft to put it at 20 ft. So maybe theres a chance they are still working with us. But we have to unfortunately wait till the 20th after the hearing to do anything else.

Don't do this. Things will probably go your way at the hearing, but if you want to add some certainty, have your contractor find examples of similar situations to yours where the twp was lenient. This sounds like a mountain out of a molehill, and boards grant variances in cases like this all the time.

I can tell you, (going to be captn obvious here ) But if the board takes a dislike to you, they can make it extremely difficult on you. Try working with them first, and only resort to litigation if that fails.
