I mean it's not like they lost Purdy to a dirty hit. Everyone on the Eagles acknowledged the game was over once Purdy went down.  Whose fault was it Josh Johnson was the 9ers back up QB? The Eagles also pretty well ran all over them.  There were no signs that the 49ers were going to be able to do the same.

That case is out of Delaware.  It doesn't have any precedential value for a case in Georgia. I would imagine Georgie does have a similar negligence theory.  I think the other big difference is that victim was also a passenger in a car involved in the race.  To the extent he encouraged the driver of his care to engage in the race, Carter would likely have a contributory negligence defense.  I think Ga is 51/49 comparative meaning the passenger would have to be found less at fault for the accident.  My guess is that there will be some sort of settlement.
