How does the government reading publicly available message board activity violate the 5th amendment? To be sure I don't love it. But it's the same sort of thing as cameras in public spaces and the library of Congress keeping copies of newspapers.

Monitoring sites and chatrooms isn't the same as "infiltrating private groups". And if they're let in by an admin or have an informant they're not doing anything against the 5th.
April 14, 20232 yr Even this message board I don't consider "private". If any idiot can sign up (which is obviously true) and say stupid maybe incriminating things (also true) I'd consider this a domain that law enforcement can operate as it might in any public business.

It just means they can't use what they find in a court of law. I don't know if joining a publicly accessible message board, for example, is a breach of the 5th amendment. The EMB only requires an email verification (I guess). If some idiot was posting national security secrets here, and a cop happened to see it OR an account associated with a federal agency that was a bot scanning these posts, I would imagine that would hold up in a court of law. If it's 100% private and the information wasn't from an informant it would be less clear to me. That's where automated capture of this information might mean a lead that isn't admissable but may still be ultimately usable in either identifying the leak and preventing further release of information, or through and informant who's flipped by the govt.
