Had my tech guys blur out the faces and our risk engineers share with customers.  Really drove up the use of surveillance cameras.  Do you guys ask potential clients about what their phone records will reveal if discovered?

Well NC is a contributory negligence state, so a plaintiff being 1% at fault kills a claim.  Because of that, slip and fall claims are nearly impossible to win in front of a jury.  Phone data while driving is definitely an issue an any MVA case.  On the workers' comp side, it is usually me that is pushing to get the surveillance of an accident. Of course, fault isn't an issue in a workers' comp claim.  I do think if a business had an employee walking and texting before they slipped and fell they would look to deny the claim as the risk of the fall didn't arise out of employment.  I have not seen that issue litigated yet. The other way I have used phone data is to establish the physical activity of jobs.  (e.g. the employer says a job only involves occasional walking but my client's apple watch says 5 miles a day).

Yes, it is now. It used to be the first 28 but they changed it last year to the entire first round.
