Some lady had a bad experience with our builder. She was refusing to pay for upgrades/changes she requested. He left the job unfinished because she stopped paying. He told her to find another contractor to finish and stopped responding to her.

She saw him at our house beginning to work.

Our structure is under 1000sqft. There was supposed to be no inspection under 1000sqft. However, I guess since the guy had to come out, he measured and said we are not far enough from the road.

 

We are approved at 20 ft. Which was written in one of their rules. However I guess the guy at the office that approved us did not have a 2nd paper that had another article in it stating that due to a corner lot, our setback on this side of the house has to be the same as our setback in the front. Which is actually 35 ft. Not 20.

Incidentally, when measuring, the guy found that our frame for the pour is actually only 18.5 ft from the road. I have no idea how they screwed that up.

 

All along he actually has been saying its their mistake. He will work with us. They just have to create a paper trail to show this has been contested so that not everyone can go breaking this rule in the future. There was supposed to be a 500 dollar variance that they are supposedly waiving. Has stated numerous times the garage will be built where it is planned, we just have to go through this stuff seemingly as a formality for them to create the paper trail.

HOWEVER, today they had a meeting with my builder. And still imposing the work stop order (wouldnt have expected that if they were trying to work with us). And are making us wait for a hearing on the 20th. And the guy (who said he was going to work with us and everything would be ok) is being a stickler about the 18.5ft (which wasnt even the reason he came out and never should have been inspected due to our square footage). This is like his gotcha moment. I think we can easily move the wood frame 1.5 ft to where it should be, but Im not even sure if they can do that with the work stoppage order. Their offer to us was that we can continue with the build if we signed a paper that says the twp. is not responsible if they decide to come tell us to fix it. Obviously we are not doing that. Thats their way of telling us to stop and putting the entire lost cost on us.

Its just craziness...

 

The 20 foot setback may be a side setback.  Most municipalities won’t allow a detached building in the front past the front setback requirement. In other words, is your garage closer to the road than your house?  Sounds like it is.  But don’t base things on your house, base it on the current zoning ordinance.  Your house may well be older than the current ordinance but as the garage is a new build, it will have to comply with the new ordinance.

The greater issue seems to be he was granted approval for the building at 20 feet, which may have been an error. 

The inspector may have simply punted this to the board to sort out because he didn't want to get in the middle of it. 

That's why he will need to have someone, either himself, his builder or a lawyer, do some leg work to see what is really going on.

So which desperate sucker is gonna give OBJ the bag? Starting to look like the Giants according to this article. Think Jerry wants him with too many conditions and is just doing his due diligence merely appeasing the recruiters on the team. Giants are desperate and will probably cave in and have a history with him. Again, don't see him helping this year that much, as his lateral movement won't be close to where it needs to be. Turns 31 next year. So cant see this contract being good long term either. It's a lose- lose, unless you get him dirt cheap. Whoever gets him, pays pretty big dollars for a big name, but a #3 slot WR. Hard pass!!

Have you applied for a variance?  Typically that goes to the Planning Commission first. They just make recommendations, not decisions.  Then the matter goes to the Zoning Hearing Board.  The Planning Commission recommendation goes to the Board of Supervisors of the Township and the Township may decide they want representation.  The Zoning Hearing Board will have legal counsel and a stenographer (the latter cost may be charged to you).  They will take testimony and then, usually at the next hearing approve the decision. You could be waiting a couple of months.
