You think Trump was competent to declassify everything in his possession before he left office? Come on, dude.

More or less, yes it has to be somewhat specific, it can't be something broad and general like "everything in Boxes B through K is hereby declassified!"

Yeah, and trumpers believe all he has to do is say, I declassify these documents and that's all it takes.

You don't think Bush, Obama, etc retained STOLE MORE THAN FIFTEEN BOXES OF classified material?   Actually dont answer because youre a moron so I dont really care

No, I don't think any of the former presidents stole boxes of classified info.

Oddly, the National Archive has not had to hunt down stolen info from other former presidents.

Of course you don't care. You love Trump and he can do no wrong.

This is due to you being both an idiot, and a fool.

I'm asking a question as to the process

That's the murky part of this I'm curious about. What are the steps to declassify something because as POTUS he had that right before he left office? Does it have to be page by page with a written record or could he have just said I'm taking these and declassifying them?

Lmao. The level of reaching here is astounding.

No, I highly doubt it.  Those I support, support the constitution and the founding principles of our country.  Good talk.

Yeah, the level of ignorance not understanding the difference between a question and a statement is astounding. People be trolling through here like any post that doesn't say orange man bad must be automatically attacked.

Probably not.

All former Presidents, Democrat and Republican, all know the laws of the land, and did not remove classified documents from the White House when their term ended.

Only Trump was dumb enough to yell declassified and walk out with whatever he wanted.

I love 70 yd because he does go big with his statements, only to fail by an absurdly bad margin.

There's a formal process to declassify documents. It needs to be documented, and the stamps and classifications on the docs need to change. It's more involved than just the President saying, Michael Scott style, that he declares something declassified.

This isn’t because of legality though, only for the problem of proving that the documents were in fact declassified.

I suppose in court it would be Trumps word against the DOJ.  Trump might say he declassified them and put himself on the witness stand to attest to that.  Then I guess it would be up to a jury from there, so definitely it behooves the president to be documented but it’s not a legal requirement

He can’t just say he declassified them, there has to be supporting signed and stamped documents to prove the official declassification.

Sure he can but a jury doesn’t have to believe he did

They have no idea what classified material is, and absolutely no clue, or desire, to learn.

You literally replied to a post explaining that declassification is a documented process. For the 50th time, he can't just say he declassified and smirk at the judge, you idiot.

By all means, keep grasping those straws and search for an explanation that doesn't include willingly breaking laws. It's fun to watch.

Go with that. Hope is a good thing.

Well, being a president and this specifically being an issue concerning presidential powers, I believe it would have to be tried in the Senate and the Senators would be obliged to make a determination of facts.  Did Trump steal the documents after leaving office, or did he declassify them before leaving?  With no proof but Trumps word, it would be a harrowing vote I’m sure

  What are you talking about?

Yes, anyone can lie under oath, but that's perjury.

Which would require an additional trial to prove

Theoretically, he could try and say he ordered it declassified, but no one followed through and took the right steps. Try and argue that the intent was to declassify. But that likely falls flat on its face for a bunch of reasons:

1. There would be no supporting evidence. Not a memo, email (Trump doesn't use it) or anything contemporaneous. All he could really do is try and have people testify that they heard him verbally say he wanted to declassify, but then they'd be pounded with questions as to why they didn't formalize that. And the kicker is, if he did just yell "DECLASSIFIED" while walking out...um, why did nobody tell the new administration.

2. Precedent matters here. Assuming Trump had declassified other info during his term, and did so the proper way, his claims of just verbally saying it would be undercut. You'd be asking people to believe that he just decided not to follow the process this time when he had in the past.

3. Trump's prior actions undercut this argument. We know that the DOJ and National Archives found classified info and demanded its return. To our knowledge, Trump made no claim that the info had been declassified. In fact, he returned 15 boxes to the Archives. His actions here are basically an admission that the info was still classified. This is the nail in the coffin -- failing to raise the argument at that time can be legally interpreted as waving it.

4. Even if he gets though 1-3, it's fair to say he has a credibility problem. Not sure any jury is going to buy that Trump magically gave an order that nobody documented anywhere and that he didn't tell the new administration about, but that magically gets him out of trouble.

If he legit committed crimes, do you want him to pay the penalty for them or not?

It wouldn't go to the Senate. It would be in federal court.

Well I’m all for laying down the law.  Someone needs to "call forth the militia to execute the laws of the union” but if Trump is the only one subject to this then no, I don’t want him to pay any penalties.  And if we are going to start actually for the first time enforcing laws, then I think it would be high time for a wave of pardons just to keep the general peace
