This mandate will be litigated, likely up to the Supreme Court.  Cruz thinks its illegal and that the Chief of Staff re-tweet is an admission of such.  I think it's an overreach - but by no means is this a slam dunk that the Supreme Court will overturn it.  Much closer call than the CDC overreach with the eviction moratorium.

Not that I necessarily agree with it all, but there's a reason why it's not an outright mandate. The optionality of weekly negative testing is to allow for religious based exemptions. Same for the 100 workers threshold to meet the legal standard of regulating interstate commerce. Pretty clear that they did their homework ahead of time to understand what would or wouldn't be upheld in a court of law.

I guess that depends on the risks we are willing to accept. Variants are going to be around for some time it would seem and they will make their way into the US despite a 95% vaccination rate in the US or whatever level you want to achieve. People will get sick and some will be serious. I would like to think that at some level of risk we decide to accept it and live with it but we will no doubt debate the level for quite some time.
